| 内容記述 | This Paper is the latter half of “Fundamental Human Rights and Paternalism”. In this paper l deal with the program of public welfare, and discuss the relationship of paternalism to public welfare. Then I scrutinize the right to maintain the minimum standards of wholesome and cultured living, and discuss its connection to paternalism.\nI claim that paternalism is not comprised in the fundamental human rights and public welfare, and does not have the appropriate position in current theories of the Constitution l suggest that liberal paternalism requires reconsideration of current theories on the fundamental rights in the Constitution of Japan.\n | |||||||
